There's no point in bullying for any reason.

Most know that, of course. Bullying is something many (dare I say most) people have experienced in some form in their lifetime. It's something that's still happening today in our workplace and schools and even at home.

Though it's not physical and if it's just words doing the damage, is it illegal in Washington State?

As it turns out, yes, it is.

According to Washington State Legislature RCW 28A.600.477

WA law on bullying.

(1)(a) By January 31, 2020, each school district must adopt or amend if necessary a policy and procedure prohibiting harassment, intimidation, and bullying of any student and that, at a minimum, incorporates the model policy and procedure described in subsection (3) of this section.
(b) School districts must share the policy and procedure prohibiting harassment, intimidation, and bullying with parents or guardians, students, volunteers, and school employees in accordance with the rules adopted by the office of the superintendent of public instruction. This requirement as it relates to students, parents, and guardians may be satisfied by using the model student handbook language in RCW 28A.300.286.

Basically, Washington schools are required to have anti-bullying policies with someone to oversee them and trained staff. If there is bullying involved, all complaints are to be handled and reported properly.

Times when people were arrested for bullying in Washington State schools

  • Bainbridge High School
  • In 2007 there were 4 students that were arrested and charged for bullying a student with autism with abuse and repeated assaults. According to court documents, the school failed to intervene. This is from PCVA Law.

  • Edmonds-Woodway High School
  • In 2015, 2 students were arrested and expelled after they were posting online threats targeting an African-American student which is also a hate-crime. This is from Seattle Times.

  • Spokane School District
  • Them reported a trans student was awarded a 5-figure settlement after ongoing bullying that eventually turned into a physical attack, leaving bruises.

    So, yes, bullying isn't just wrong, it's also illegal. If you feel your child is being bullied in school, tell the school district and, legally, they have to look into it.
