Starting June 10, 2026, Washington State has a new law classifying how electric bikes are used compared to motorcycles and mopeds to have a clear distinction between the two.

If your e-bike doesn't qualify, you might need to get a different type of license to use your own electric bike.

What Qualifies as an E-Bike

For Washington State, there are few things to consider with your electric bike to have it count as an electric bike.

  • There must be fully functioning foot pedals.
  • The motor has to be 750 watts or less.
  • It can't go faster than 20 mph on just the motor.
  • The purpose of the electric bike is that you pedal the bike but the motor assists as needed, especially going up hill. It's great for that. However, most electric bikes have a throttle or trigger you can press so it will move without pedaling.

    Electric Bike vs. Moped or Motorcycle in WA

    I have seen some customized electric bikes there the pedals are removed and they just put little places to rest your feet so they just use it for the motor. It's fine if you don't want to pedal but without that option this may place your electric bike in that other category where using it would require a license.

    If that were the case, you may need, not only a driver's license to operate your electric bike that goes faster than 20 by motor alone, doesn't have pedals, or is more than 750 watts, but also may require insurance and registration. It could also mean you'd need motorcycle equipment requirements as well.

    Best to check your electric bike to make sure this isn't the case for the e-bike you're currently using. Most e-bikes already qualify without license and all that, but good to check just in case.
